ALL RESERVATIONS PAID THROUGH THE BONBONNIERE.COM.MX SITE AS WELL AS THROUGH THE PERSONALIZED PAYMENT LINK, ARE SUBJECT TO THE PRESENT TERMS AND CONDITIONS.

The terms "Bonbonniere", "Bonbonniere Tulum,", “www.bonbonniere.mx”, “the site”, “the platform”, "we" and "our" refer to Tecnologia y Diversion SA de CV, Mexican company with Federal Taxpayers Registry TDI161012B29 and located at Carretera Estatal Tulum - Boca Paila, Parcela 1744-A NCPE Jose Maria Pino Suarez, Tulum, Quintana Roo 77760.

The term "You", “Guest(s)”, “Client(s)”, “User(s)”, “card holder”, refers to the user of the services offered by Bonbonniere Tulum through the website “www.bonbonniere.mx” and / or through any other sales channel currently or in the future used by Bonbonniere Tulum to offer and sells its Services.

Www.bonbonniere.mx is an e-ticket which sales tickets for the venue Bonbonniere Tulum, whose technological platform allows that through various entertainment service providers (Consumption Venue), to offer and commercialize it services to “users / cardholders / guests”; who in turn can make inquiries about events and services, compare and reserve them in real time according to their needs and preferences.

These ‘Terms & Conditions’ may vary from time to time, adding new clauses or modifying the existing ones. Please make sure to review them periodically.

The access and use of the website “www.bonbonniere.mx” as well as to complete a reservation through a personalized payment link, implies your full acceptance and undertaking to abide entirely by the Terms and Conditions.

Bonbonniere Tulum is not the final provider of the services and just acts on behalf of the Consumption Venues, so it is not obliged - directly or indirectly - to the execution of the Service. When you, the client, contract the services offered through www.bonbonniere.mx you are entering into a contract directly with the Consumption Venue that offers its services through our platform. Bonbonniere Tulum acts as an intermediary between you and the Consumption Venue.

When contracting any service through our site, the client guarantees and declares under protest to tell the truth that:

I) Is of legal age;

II) You -the Client-, expressly accept these Terms and Conditions, which you have fully understood and expressly consent to use electronic means;

III) Has full capacity to enter into contracts;

IV) Only use the platform and site to contract services for you.


I. ACCESS TO THE CONSUMPTION VENUE OFFERED BY BONBONNIERE TULUM

To access the venue it is essential to be of legal age (+18) and have official identification to prove it. Bonbonniere Tulum and the Consumption Venue, reserve the right to request ticket holders to provide appropriate ID for proof of age purposes.

The management of the Consumption Venue reserves the right to refuse the admission to any person appearing to be intoxicated, under the influence of drugs, or otherwise behaving dangerously or inappropriately. No refunds will be given under these circumstances by Bonbonniere Tulum or the Consumption Venue.

For security of the 'Clients / guests', the Consumption Venue sold through www.bonbonniere.mx, reserve the right to carry out inspections prior to entry, in clothing, bags and any other element that they consider, and the Consumption venue reserves the right to confiscate any material / element that it considers dangerous or that may alter the order within the Consumption Venue such as the following items: Chains or spiked jewelry, offensive prints on clothing, oversized bags, backpacks, wallets or packages , costumes that resemble authentic public safety uniforms (police, military, fire, security, or medical) to any reasonable degree, weapons or weapon accessories of any kind (including firearms, pepper spray, pocket knives, fake weapons/props, whips, lightsabers) and all sharp objects, controlled substances, eye drops, liquid makeup, gum, outside food or beverages (including alcohol and candy), liquids, vitamins, supplements, over-the-counter medications, prescription medications, medicines and products with CBD, THC or any psychotropic, drones, cameras (semi-professional professionals) / video cameras (professional / semi-professionals), personal computers, remote-controlled aircraft toy, laser pointers, wearable technology, selfie sticks, tobacco, cigarettes, ?electronic cigarettes, vaporizers (vape), cigarettes, balloons, markers, pens or spray paint, flowers, toys, inflatables, glass, cans, cups, coolers, signs attached to a stick, and any other items that management is considering at the time. This list of examples is illustrative, but not limiting.

Also be aware that professional and semi-professional audiovisual survey items such as recorders, cameras, camcorders, drones, go pros, etc. They may only be used within the facilities and the corresponding airspaces with a prior written authorization from Management, Direction or through the email bookings@bonbonniere.mx ?

Access to the venue requires compliance with a “formal dress code”. Dress code is strictly enforced. The Consumption Venue reserves the right to refuse entry if the “Client / User” does not comply with the dress code (No swimming suit, no caps, no sandals, no sport shorts).

Food and drink purchased elsewhere may not be introduced or consumed inside the Consumption Venue.

Neither Bonbonniere Tulum nor the Consumption Venue are responsible for the belongings that the 'Clients / Guests' bring with them to the Consumption Venue and are exempt from indemnifying the 'Clients / Guests' in case of loss of their personal belongings. To help the Consumption Venue to give a better service, please report any lost items as soon as possible to the staff so that every effort can be made to reunite them with your items.


II. BONBONNIERE TULUM E-TICKET TERMS & CONDITIONS

The confirmation sent to the email that the 'Client / User' registers at the time of making an online purchase, is called an Electronic Ticket or E-ticket.

A) Check-in time

The 'Client / Guest' must present himself at the reserved Consumption Venue as soon as possible, considering the check-in time at 11:00 PM (service starting time -except for events that indicate otherwise-), since in case that the venue exceeds its maximum capacity, access will be denied without any right to reimbursement or compensation.

The average time to validate a reservation is 10 minutes, but the entrance to the property can take between 10-15 additional minutes. For special events, the waiting time could be longer.


B) Validation of an electronic ticket

In order to validate an E-Ticket at the Consumption Venue it is mandatory to present:

  1. E-ticket printed or displayed on your smartphone (it includes a confirmation number, QR code and date of the event).

  2. Cardholder ID physically. (Copies or photos will not be accepted)

  3. Credit card used to book physically. (Copies or photos will not be accepted)

If the payment was processed with a digital or virtual card, the 'Client / Guest' must present at the time of check-in from his banking app, the last numbers of the digital/virtual card and the charge reflected in his account statement.

In order to prevent and avoid fraud to our 'Clients / Users', Bonbonniere Tulum and the Consumption Venue reserve the right to photocopy, take a photo or print any of the documents mentioned above.

When the required documents are not presented and one or more of the requirements are not accomplished, the reservation will not be validated and it will be considered a no-show. No-shows do not apply for refunds.

IMPORTANT:

Reservations over $500 USD, a charge of $10 MXN will be required directly at the Consumption Venue directly to the credit card used to book for security reasons. If the credit card holder refuses to pay this charge, the reservation will not be validated.

C) Change of date to the E-ticket by the 'Client / Guest'

Any change of date of a confirmed e-ticket must be requested by the 'Client / Guest' via email to bookings@bonbonniere.mx with at least 48 hours anticipation to the date of the reserved event. Date changes may be subject to rate adjustments, which must be settled by the 'Client / Guest', either through online payment or directly at theConsumption Venue.

D) Change of name to an E-ticket

As stated above, the “Client / Guest / Cardholder” is the only one who can validate the electronic ticket at the Consumption Venue.

If the “Card holder” wants to transfer the ticket to a third-party, it is necessary to send a request by email to bookings@bonbonniere.mx within 48 hours prior to the date of the event reserved. Additionally, it is mandatory to fill in an authorization form and send it by email with the identification of the cardholder and the identification of the beneficiary, plus the information that Bonbonniere Tulum considers necessary. When the authorization form is rejected, the “Cardholder” must validate himself the reservation directly at the door with the documents mentioned in clause B, otherwise his reservation will be considered a no-show.

E) No-Show

Electronic tickets are only valid for the specific date purchased, and must be claimed by the “Client / Cardholder” on that specific date, directly at the Consumption Venue during the valid check-in time.

When the “Client / Cardholder” does not show up to claim the contracted services, without prior notice to Bonbonniere Tulum, the reservation will be considered a “No Show”, therefore, there will be no refund by Bonbonniere Tulum or the Consumption Venue regarding the contracted services.

F) Cancellation by the 'Client / Guest'

The cancellation of any ticket booked through www.bonbonniere.mx must be requested via email to bookings@bonbonniere.mx, at least 48 hours in advance of the date of the reserved event / service.

Cancellation charges are as follows:

  • Cancellations requested with 48 hours -or more- in advance to the date of the event booked, will have a 15% penalty on the total paid online.

  • Cancellations requested less than 48 hours before the date of the event booked, will have a 50% penalty on the total paid online.

  • Cancellations requested after the date of the event, will have a charge or penalty of 100% of the total paid online.

G) Cancellation by Bonbonniere Tulum

Bonbonniere Tulum and / or the Consumption Venue reserve the right, at their absolute discretion, to cancel any purchase / reservation without prior notice. In these cases, the refund of the amount paid by the “Client / Guest” will be made and the reservation will be canceled without any liability for Bonbonniere Tulum or the Consumption Venue.

H) Limiting use of the E-ticket by the 'Client / Guest'

The “Client / Guest / cardholder” declares and warrants that the ticket is purchased for personal use only, that it is prohibited to sell it or offer it for resale. Resale or attempted to resale a ticket is grounds for cancellation of that ticket and the reserved service, causing the "Client / User" to be denied entry or expelled from the Consumption Venue, without reimbursement or other compensation on the part of Bonbonniere Tulum or the Consumer Venue.

Unauthorized changes or modifications to the e-ticket are considered fraud and any person who presents a modified ticket will be consigned to the competent authorities. We reserve the right to initiate the corresponding legal actions in case of misuse of the ticket.

Bonbonniere Tulum will not be responsible for any ticket that is lost, stolen, duplicated or destroyed. You are solely responsible for the safe-keeping of your printed ticket(s).

I) Adjustments for special events

In the case that a special event is confirmed by the Consumption Venue for a date reserved by a "Client / User" and a difference in rate is applied, the difference corresponding to the new price set to enter the event must be paid directly at the Consumption Venue by the "Client / User".

If the “Client / Guest” cannot / does not want to pay the difference or is not interested in changing the date, a refund of the total of the reservation may be requested to the email bookings@bonbonniere.mx, with at least 24 hours of anticipation of the original date of the reserved event. Any request received past this date will have a penalty charge of 50% of the total amount paid online

J) Events Calendar Modifications

If due to causes beyond the control of Bonbonniere Tulum or the Consumption Venue, the calendar of events might be changed or modified, in these cases the “Client / Guest” will be notified of this change by email.

If an event is rescheduled, “Client / Guest” will be offered tickets to the rescheduled event. In this case and like an exception, if the “Client / Guest” cannot / does not want to attend the rescheduled date, the ticket could be changed for another event /date by paying the difference if applicable. In case that the client is not interested in changing the event/date, a refund of the total of the reservation may be requested to the email bookings@bonbonniere.mx, with at least 24 hours of anticipation of the original date of the event. Any request received past this date will have a penalty charge of 50% of the total amount paid online.


III. ONLINE PAYMENT CONDITIONS

A) Online Payment

For the payment of the selected services, the “Client / Guest / Card Holder” will connect with the bank's processor gateway in charge to complete the purchase process. Neither Bonbonniere Tulum nor the Consumption Venue will have access to the financial information of the “cardholder/ client”, except when it is a manual reservation and the information is shared by digital media, in this case Bonbonniere Tulum guarantees the correct use of data. Each online payment is made through a secure connection, for more information please refer to the website of the payment processor.

B) Payments Accepted by Bonbonniere Tulum

The payment method accepted by Bonbonniere Tulum is by debit or credit cards. Our bank platform accepts Visa, MasterCard, Discover and American Express cards. At the time of making the reservation, the total amount of the reservation will be charged to the card.

As previously specified in section A) of Title II, the cardholder is the only person authorized to validate the reservation and it is essential that they appear in person with the card used to pay for the reservation and with an official identification to validate the tickets / services purchases. Copies or photographs of the card or official identification will not be accepted.

If the online payment is made with a digital or virtual card, the cardholder must physically present their identification and show their digital or virtual card from their banking app and the account statement where the charge for their purchase is reflected.

C) Billing

In case of requiring a tax invoice, it must be requested by email to bookings@bonbonniere.mx, indicating the tax information to be noted on the invoice, as well as the reservation number. It is important to inform that for fiscal reasons the invoices will be elaborated during the month of purchase of the service, even if the date of use of the tickets is later. In case of deposits or bank transfers, invoices must be requested within the same month the deposit or transfer is made. Once a tax invoice has been made, the reservation or e-ticket will not be refundable, nor can the date/event be changed.

D) Currency and exchange rate

Payments on the Bonbonniere Tulum site are through a banking provider platform and are made in Mexican pesos, the exchange rate of the "Site" is variable and is published at the top right of the page www.bonbonniere.mx 

For purchases from abroad or internationally, the charges are made in the currency of the country where the card was issued. Bonbonniere Tulum does not establish the amount that the bank of the 'Client/User' will charge to their card since the amount depends on the type of change and rate determined by said financial institution.

E) Inclusions and exclusions

The inclusions and exclusions of each reservation vary depending on the reserved service and are specified at the time of booking. Benefits not specified in these Terms and Conditions, it is not the obligation of Bonbonniere Tulum nor the Consumption Venue to grant them within the reserved service.

F) Service Unconformity

If during the reserved event there is any doubt about the reserved service and/or its benefits and inclusions, style of the event, music, quality of the drinks or any other non-conformity or disagreement, the 'Client / User' must consult with the Management of the Consumption Venue at the time so that any doubt is clarified at the moment of the service is rendered. Any of the employees of the establishment will put the 'Client / User' in direct contact with the Manager on duty. Non-conformities not reported during the event may not be the reason for future claims, returns or chargebacks.

G) General recommendations

In case of injury or accident, please inform the Consumption Center staff immediately. The Consumption Venue has highly qualified personnel to help with any medical matter. For the busier events, they have the support of the local medical team within the facilities in case of any problem.

Bonbonniere Tulum recommends to the clients to act and drink responsibly inside the Consumption Venue.
